US visa refused under 214(b): what it means and how to reapply
A 214(b) refusal means the consular officer was not convinced you will leave the US after your visit. It is not a ban and it is not about a missing document. You can reapply at any time, but you should change something real about your situation or how you explain it first.
What 214(b) actually says
Section 214(b) of the US Immigration and Nationality Act presumes that every visitor intends to immigrate. You have to overcome that presumption. When an officer refuses under 214(b), they are saying that, based on your DS-160 and a short interview, you did not show strong enough ties to India or a clear enough temporary purpose.
The refusal slip is a standard form. It does not list your personal weak points. That is why so many applicants reapply with the same profile and get the same result.
Why it is happening more often
The adjusted refusal rate for Indian B visa applicants rose from 16.32%[source] in FY2024 to 22.04%[source] in FY2025. Officers have very little time per applicant and very long queues. A file that is confusing, inconsistent or thin is easier to refuse than to question further.
The most common real reasons
1. The purpose of the trip is vague
"Tourism" with no dates, no plan and no budget sounds like an excuse. Know your dates, places, who you are travelling with and how much it will cost.
2. Ties to India look weak
Officers look at your age, job stability, family situation, assets and travel history together. A 26 year old, single, three months into a new job, with no travel history and a sibling in the US, faces a hard interview, however honest.
3. Inconsistencies
Your DS-160, your interview answers, any earlier US applications and your employer's letter must tell the same story. Even small differences, like a different job title or salary, damage credibility.
4. Family in the US
Having relatives in the US is not a reason to refuse. Combined with a long stay, weak ties or a relative with uncertain status, it raises the officer's concern about overstaying.
5. Money that does not add up
There is no minimum balance. The concern is consistency: income that matches your job, savings that built up over time, and a trip cost that fits your means.
A practical recovery plan
- Write down what you were asked and what you said, as soon as you can after the interview.
- Compare it line by line with your DS-160. Find every gap.
- Identify what has genuinely changed, or can change: a confirmed promotion, a property purchase, a shorter and more specific trip, travel to other countries with return.
- Fix the DS-160 honestly. A new DS-160 is needed for every application. Correct any earlier mistakes and be ready to explain them.
- Prepare for the interview. Practise short, direct answers. Officers prefer one clear sentence to a speech.
- Choose timing carefully. Reapplying immediately with nothing changed rarely works.
How VisaVisa's Refusal Recovery plan works
You share your refusal slip and previous DS-160. A senior reviewer audits the previous application, identifies the likely causes, rebuilds the file with you and runs a mock interview. If you are refused again, we refund 100% of our service fee. We will also tell you honestly if we think you should wait before reapplying.

Frequently asked questions
How long should I wait to reapply after a 214(b) refusal?
There is no mandatory waiting period. Reapply when something meaningful has changed in your circumstances or in how clearly you can explain them. Reapplying the next week with nothing changed usually gives the same answer.
Does a 214(b) refusal affect other visas?
You must declare previous refusals on future applications, including for other countries. One honest, explained refusal is not a ban, but hiding it can be treated as misrepresentation.
Can I appeal a 214(b) refusal?
There is no appeal for a 214(b) refusal. The way forward is a new application.
